Franchising In The Philippines

Franchising has been in the Philippines for 94 years. With the entry of Singer Sewing Machine in 1910 which introduced product distributorship. Numerous companies embraced this concept as their vehicle for business expansion over the years. From 1910 to 1965, businesses staked their flags in the Philippine economy through PRODUCT DISTRIBUTORSHIP. Some of these multinationals were tire and pharmaceutical companies.

The take off was slow in the early years as the succeeding companies like A&W Restaurant known for its root beer entered in 1965. The first outlet was established on Highway 54 (now popularly and historically known as Epifanio Delo Santos Avenue or EDSA) near the Big Dome-Araneta Coliseum. The concept was a drive-thru where women food attendants garbed in mini-skirts, black stockings and in roller skates would serve customers inside the comfort of their cars. Trays clamped by the side of the door and mugs with cold refreshing root beer partnered with foot long hotdogs were served. Its set-up was exactly the same as found in the US branches during those years. What this company brought was another form of franchising, which is known as Business Format. From then onwards most entrants into the market embraced this concept, in fact, so widely used not only in the Philippines, but all worldwide.

Product Distributorship

This is a form of franchising where owners of products allow other parties to sell or distribute their products or even use their trademark as a dealer. There is minimal or no control of operations. The relationship is centered on the quality of products sold.

Business Format

A form of franchising used by 90% of companies involved in franchising. This is the reason why franchising is considered the most successful way of expansion worldwide.

In business format, the franchisor, more than his registered trademark and products, has developed a business system that is made available for use to franchisees. Compliance to the business system is the core and essential element of their contractual relationship embodied in a franchise agreement.

The first survey of franchising in the Philippines done in 1995 revealed that there were a total of 50 operating foreign franchisors at that time. The success rate of foreign franchisees is 97%. In 2003, there were 315 foreign franchisors in the country with 87% success rate.

Philippine Based (Home-Grown) Franchises

Earliest recorded homegrown company that used business format franchising was PANCAKE HOUSE. It was franchising since 1978. PANCAKE HOUSE is still active in franchising and has transferred ownership a few years back.

In 1996, there were 94 companies using franchising as their route to expansion and the number has substantially increased to 481 in 2003. The success rate is a good 90%.

Philippine Franchise Scenario

Franchising in the country evolved from the US Franchise System. There are, however, no laws that regulate franchising. Companies and franchise developers use international franchise practices as reference and as a guide to pursuing this type of business. The increasing number of homegrown companies using franchising in their expansion can be attributed to the presence and increasing number of foreign franchisors. They served as motivators and inspiration for the local entrepreneurs.

Franchising for years has been the monopoly of food sector. It was only in mid-1990’s that service and retail entrepreneurs used franchising.

There was an absence of franchise education in the country for decades. Franchise Conference and Seminars started only in the mid-90’s. Franchise Associations were also formed with the vision of professionalizing and standardizing the franchising as well as police their own ranks.

How To Change An Existing Employment Contract

If you want to change an employee’s terms and conditions of employment, you will need to get their agreement first. Otherwise, the employee may be entitled to sue for breach of contract, or resign and claim constructive dismissal. You must tell the employee in writing about any changes no later than one month after you have made the change. Do changes have to be in writing? Agreed changes don’t necessarily have to be in writing. However if they alter the terms in your ‘written statement of employment particulars’,

Your employer must give you another written statement showing what has changed within a month of the change. Employee Enforcement of the Right Employees have certain rights. These rights are enforceable by law: The right of fair treatment regardless of age, race, religion, gender, disabilities, or sexual preferences The right to equal treatment, also with regard to wages The right no be dismissed without proper cause and the correct procedures The right not to get fired for giving birth to a child Employees also have the right to a proper written notice time for termination of their work agreement in relation to the period employed Employees have the right for compensation when they are retrenched Safe workplace Terminating the Employment ContractBoth employer and employee can terminate the employment contract according to the terms contained within it. Either side can make a complaint against the other.

Breach-of-Contract Claims Both employers and employees can be in breach of a contract of employment. A breach of contract happens when either employee or your employer breaks one of the terms. If an employee continues to work under these changes without objecting, they may be regarded as having accepted the changes. Not all the terms of a contract are written down. A breach may be of a verbally agreed term, a written term, or an ‘implied’ term of a contract. Employer would normally use a county court for a breach of contract claim. The only way an employer would be able to make an application to an Employment Tribunal is in response to a breach of contract claim that an employee has made. The most common breaches of contract by an employee are when they quit without giving (or working) proper notice, or when they go to work for a competitor when their contract doesn’t allow it. Our Employment Law DocumentsAvailable documents include employment contract templates, as well as a director contract template and a range of employment policies. Our documents are designed for use in England and Wales. Our Contract of Employment Template is easy to customize to your business’ requirements.

They provide comprehensive legal protection, whilst avoiding excessive legal jargon. They have been designed with ease-of-use in mind. To this end, they include guidance notes. They are excellent value and available for immediate download. All the templates have been drafted by a team of Solicitors and Barristers who are expert in the field of employment.

Could See A Crisis In Food Scarcity According To The Un Food And Agriculture Organisation

According to the latest predictions from the UN’s Food and Agriculture Organisation (FAO) price volatility, climate change and crop diseases combined with poor harvests in 2010 could herald another food crisis in 2011, particularly in parts of Africa and Asia.

Floods in Pakistan and China and the summer drought in Russia, which led to a ban on all wheat exports this year, mean that stocks of wheat, maize and some other foods were not as high as in previous years.

It has already been seen that this has led to to commodity price speculation that pushed up the prices of these grains and food by 40% in a few months and food price inflation is currently running at 15% per year.

Almost certainly consumers and shoppers in most of the world will be facing higher food bills in 2011. The FAO’s November monthly report forecasts that these factors will lead to a running down of global food reserves, which are currently at around 74 days, and an increase in prices of between 10% and 20% in 2011.

The prediction is its most pessimistic since 2008, when more than 25 countries experienced food riots after price rises precipitated a food crisis that hit the poorest in many parts of the world.

Several other factors add to the problem. Current forecasts for world grain production next year are at 2% below 2009, lower than was anticipated last June, when production for 2011 was being forecast to expand.

In addition, the FAO says, climate change and the competition between food and biofuel production means that grain crops particularly command higher prices as biofuel rather than as food.

Increasingly unpredictable weather patterns attributed to climate change are adding to the situation’s volatility and the potential for further price speculation as well as the ongoing problem of some increasingly intractable diseases such as wheat rust, a fungus that can seriously affect the level of the harvest.

The report says: “The most feared disease of wheat’stem rust has re-emerged in a new virulent form, and new aggressive stripe rust strains are devastating wheat crops in several countries.” Since was first identified the pathogen, which is wind-borne and can travel up to several thousand kilometres, has continued to mutate and spread.

While reaching global agreement on tackling such issues as climate change and combating the temptation towards price speculation, protecting national economies by using import tariffs and restrictions in a global economic crisis may be moving far too slowly to have any major impact on food production and scarcity in the short term there are other strategies that could be used.

One is taking urgent action to restore degraded land around the world. There is an estimated 1bn hectares-plus of land with the potential to be restored. Another is to increase the fertility of existing land. In the context of improving fertility the use of disease resistant seeds, integrated pest management and conservation agriculture can all play a part.

The work of biopesticides developers in devising low-chem agricultural yield enhancers, biopesticides and biofungicides, all of which are kinder to the environment, soil and ecosystems could be particularly helpful to poorer small farmers in the developing world as long as there is wider agreement on speedy regulation and licensing as well as proper training and financial support for farmers to be able to access them.

Retail Branding

Retailers and manufacturers are constantly on the lookout for new ideas and strategies to spur growth. And while smart companies are giving digital serious consideration, theyre not doing it at the expense of the store experience. Likewise, in our excitement around mobile shopping, lets not overlook our physical spaces and the tactile experiences they offer. Yes, stores have been our retail workhorses for centuries, but dont make the mistake of assuming weve wrung every bit of growth to be had from them. What can be done to spur growth from the fleet of branded spaces that currently exist? Plenty.

When I look across most categories, I see great similarities between competing brands. Brands get stagnant and complacent. All it takes is a little courage to get beyond the safety of sameness. I believe innovative thinking can only happen when you take a long hard look at your brand and ask, “What if?” What if we look at things from a different perspective? What if we do things a new way?

Customers get excited by new. We see this time after time when we open a store, especially if the exterior has had a makeover. Inevitably, customers who have forgotten about you will try you again. “New” attracts attention. The good thing about new is that it comes in a variety of degrees, from a complete overhaul to a new coat of paint and some impactful communications. Sometimes new can come in the form of an exciting offer. The worst thing you can do is not try. Dont fear failure. New ideas can be tested and adjusted, several times and ways, until the register starts ringing.

Recently, a client told us the secret of their instore success. They are always asking themselves, “What if?” And as a result, they continuously give the customer something they haven’t seen before. Something new. So theres always a little excitement, a reason to shop. The opportunity is there, in every square foot. All too often, the problem is with the limits of our thinking not with the limits of the store.

Get the Best Agriculture Equipment for Unique Performance

Agriculture is one of the main activities in almost most of the countries. With such high demand of agriculture, it has become very important to use some of the extra-ordinary kinds of equipment at the same time. People are willing to use some of perfect equipment, which is sure to increase the production as well as reduce down the total effort in the same. Seeds are very important as these are the important product in agriculture. With proper grading of the seed, the quality of the seed is enhanced to a higher level. People from various parts of the world are willing for the latest technology to be used in agriculture. The seed grading equipment are such kinds of equipment, which can easily handle the grading process of the seed.

There are other kinds of products such as the digital moisture meter. This particular meter mainly checks the moisture in the environment. The exact moisture is recorded by the machine. People need to check the moisture level in the agriculture field for one reason or the other. With the help of the new digital moisture meter, it becomes very easy to record the moisture content in the air. This will further help to maintain the conditions as per the demand. With the development of technology, lots of new moisture meters are developed, which can record the moisture content without much problem. There is no much hassle involved while using these meters. They are very handy in nature and any one can easily use it.

The moisture meter as well as seed grading equipment can serve farmers in a very perfect manner for better productivity. There are many other kinds of products in the list, which can easily enhance the production as well as efficiency. The seed grading machine are now coming in automatic modes. Thus, one need not to worry much about the handling process. It is very easy to operate and the size varies as per the demand. Most of the models are very normal and, which are perfect in handling good work loads. This is also a very cost effective method in cleaning various kinds of cereal grains. The seeds are directly fed to the lower part, where it gets sucked by an aspirator. All the dust and other particles are cleaned properly and the waste products get collected in the bins. So, agricultural production can be increased to a great extent with the help of these devices.

A-GRAIN (India) is involved in the development, manufacturing and marketing Post Harvest Test Equipments and Seed Processing Machinery. We also manufacture a host of products like grain moisture testers, seed dividers, seed germinators, seed processing plants etc. To get more details visit us.

Sustainable Agriculture Farmers Going Greener

Sustainable agriculture refers to the creation of a system whereby farmers can farm their land indefinitely. Sort of like a battery that could provide power and be recharged simultaneously. Sustainable agriculture depends upon the ability of farmers to anticipate problems caused both naturally and unnaturally, i.e. as a result of farming, and overcome them.

An example of a natural problem would be drought; an unnatural problem would be nitrogen depletion in the soils as a result of harvesting crops. While man cannot directly control natural occurrences like drought or other extreme forms of weather, they can control their own impact on the land and that’s where the practices of sustainable agriculture are focused.

The common problem of nutrient depletion in the soil can be addressed in a few different ways, some of which are actually feasible right now, some of which are only proposed and depend upon the further development of technology in order to be viable. One possibility is to recycle crop waste and livestock or human manure. Another is to grow legume crops that engage in a symbiotic relationship with nitrogen-fixing bacteria.

A modification of the Haber Process (which produces nitrogen industrially with hydrogen gas) could be sustainable if the hydrogen were obtained from electrolysis powered by wind mills or solar cells instead of getting the hydrogen from natural gas as the Haber Process currently calls for. The last solution, while ideal in many respects, requires greater advancement in the field of genetic engineering.

That solution would be to engineer non-legume crops that produce nitrogen either through symbiosis or without it. Like nutrient depletion problems, the ability to irrigate crops without using up water supplies also demands attention.

Unfortunately for farmers, rainfall does not supply an adequate amount of water for crops in many areas of the world. Irrigation addresses this problem, but when a resource of water is tapped for irrigation and the rate of water use from the resource is greater than rate of water renewal at the source of water, then the water will be depleted. In such situations the sources of water cannot be considered renewable and therefore do not qualify as viable options in creating a sustainable farm.

However, when water can be used at a rate lesser than or equal to the rate of recharge at the source, a farm can be sustainable. Sustainable farms can support those who desire to produce natural products.

Natural products are ones that have not been influenced with inorganic compounds like pesticide or growth hormones in animals. Farmers wishing to market natural meat as a product raise their livestock on sustainable farms in order to be self-sufficient. Some successful farmers, catering to a growing organically inclined market, even sell steaks online.

Multi-functionality Of Agriculture Part Ll

In the context of the WTO, the issue relates to the effect of trade distorting subsidies on the related and interconnected aspects of a multi- functional agriculture. While it is known that subsidies to the dairy farmers in Europe and US depresses the domestic price of milk and milk products for the milk producers of the developing countries, it is difficult to assess the impact that non-rearing of cattle as an adjunct to the family farm will have on the multi-functionality of agriculture in larger parts of Asia and Africa. At a more fundamental level, the question is should the term for the milk and meat products of Europe and US be called the dairy farm sector, or the dairy industry for it is more in the nature of an industrial production process, rather than an agricultural operation. Proponents argue that the current patterns of agricultural subsidies, international trade and the related policy frameworks do not facilitate a transition towards an equitable agriculture and food trade relations or sustainable food and farming systems.

On the contrary, these have given rise to perverse impacts on natural resources and agro ecologies, as well as on human health and nutrition. Raj Patels book Stuffed and Starved which was reviewed by this column, subscribes to this view. They suggest that while knowledge, information and technologies of agriculture should have free circulation, agriculture production should be rooted in the local context and respond to the multiple needs of the community, and contribute those resources to the community which have traditionally beenassociated with agriculture. However, the other view, which also has a fair number of proponents, including those from the Consultative Group on International Agricultural Research (CGIAR) affiliated International Food Policy Research Institute (IFPRI) argues that any attempt to remedy these outcomes by means of trade related instruments will weaken the efficiency of agricultural trade and lead to further distortions in the market. They argue that the number of rural households which do not depend on any kind of agricultural activity is rising, and therefore the multi-functionality has little meaning, especially for the poorest and most deprived sections, which do not have access to any land, including homestead land.

There is some empirical truth in this fact as well, for the numbers of landless labour in India (who do not have any rights over land) are more than the total number of marginal and small farmers. Thus, multi-functionality has no meaning for them, or the large numbers of the urban poor, whose primary concern is the access to affordable nutrition, rather than a return to the highly romanticized versions of bucolic climes!

AgriMatters would go with the proponents, because there are ways in which multi-functionality can be integrated into the lives of almost everyone who lives in the countryside. As governments and communities across the world recognize the right to

shelter, and the provision of a small plot for homestead land is getting the status of a Fundamental Right, it would be possible for landless workers to grow timber, vegetable, fruits and nuts both for self consumption, and the market, as also keep engaged in backyard poultry, duckery and a few goats and/or milch cattle. In other words, agriculture is so integral to the farmers and farm workers that it cannot be subject to decisions based on the manipulation /calibration of statistical tables and projected scenarios.

Music retail market

I know the title of this essay looks a tiny bit weird but stick with me and I’m going to explain all. In this post you will learn the no1 way you can increase your fan base and build a successful music career…starting at this time.

After I stopped listening to Music promoting Gurus who had not done anything in the music game and started to follow and learn ninja skills from folk who were actually making millions of greenbacks online, everything became far easier.

Now all I do is copy what these fellows do to make so much cash then transfer it to my music.

So here they are , the top two things musicians can find out about marketing from the old school web marketers…

Free Traffic is Best.

For the music marketeer you truly want to be going after a free traffic model in your business. The cause of this is that most indie music artists are on a restricted budget and if you are spending cash everyday on advertising you may probably go out of business.

the right way I know to get free traffic to your site is to post a video to YouTube everyday of your group covering a current chart hit. If you keep at this it’s guaranteed free traffic for life!

If you believe your band is rubbish?

I find the reason lots of bands and artists fail to make any headway in their career is they do not trust in their own music and think that there’s no way on earth that they could ever make it in the business compared to other artists like lady Gaga and such.

But if you’re rubbish that’s OK, just fess up because i have a secret sauce you can add to your music which may leave you 10 times before most other artist if you just implement it every day.

The technique goes like this….

So the simplest way to become great in music is to spend half an hour each day writing new stuff. I’m going into the bathroom with my iPhone and get the ideas down on tape without editing anything out. I just sing and play whatever on earth is in my head and set my iPhone timer to half and hour in order that I do not have to keep consistently taking a look at my watch.

Doing this I have more songs than I know what to do with and after a month I am able to really notice that the standard of my music is much better than when I started.

It’s cheesy but I believe each great singer or guitar player started being rubbish and because they practiced every day they where in a position to bring the standard of their stuff up to standard.

Final thoughts.

I could go on all day about these new music selling strategies but I need to finish this articles here. The important thing you should take away from this is that you’ve got to become a student of selling and work on your promotions each day.

The Safety Of Our Food Supply Is In The Hands Of Agriculture Workers

Many people are not aware of the enormous role that agricultural workers play in our daily lives. It is obvious that the fruits and vegetables that we eat come from farms. However, agriculture jobs affect far more aspects of the typical diet than solely plant matter. The animals that we consume eat grains that are cultivated by farmers. Even the most processed foods such as cookies and crackers contain farm-grown products, and many preserved foods utilize agriculturally-derived products to sustain the substances’ nutrients and prevent the growth of harmful bacteria.

Agriculture jobs are therefore extremely important in protecting our world’s food supply. While we might not exclusively consume fruits and vegetables, all of our food products are linked in some way to the farms.

The most typical agriculture job that people associate with this field is that of the basic farmer. Society’s modern farmers do not receive nearly the amount of credit that they deserve. These workers labor long hours in oftentimes harsh conditions in order to provide the general public with the sustenance that it needs, and although industrial machines are replacing the jobs of many agricultural farmers, these people still play an enormous role in protecting the world’s food supply.

However, not all agricultural jobs involve the planting and harvesting that most people envision when discussing this area of study. Agricultural scientists are immensely important in providing society with the food that it needs. These scientists study crops and livestock in order to discover more efficient methods of farming. Pest control methods, sustainability, and environmental impact are also researched extensively to ensure that farm products can still be provided to the world’s citizens in the years to come. These scientists perform numerous experiments to try to discover new compounds that can be safely consumed or added to the soil to improve crop yield. In recent years, agricultural scientists have increased the world’s crop yield by an astounding percentage. Their work in creating new agricultural methods to make farming more accessible to be people in rough environments also helps to eliminate worldwide hunger.

Whether the agriculture job involves complex scientific research or the simple maintenance of a field of crops, workers in this field are incredibly important to the welfare of modern society. Without the hard labor of farmers and agricultural scientists, we would not be able to produce enough food to sustain the world’s population. Agriculture jobs play a central role in ensuring the health of the world’s people.

Image Recognition Technology A Driving Force For Retail Industry

Image recognition technology has converted the world into a shop window. According to new market research, this is most likely to have the highest impact on retail sales. Advance technologies like store based technologies, interactive television, smart devices, and augmented reality along with image recognition will play a significant role in reshaping the retail environment. These technological innovations are riding the crest of both online and mobile shopping. And the latest phase of these unique technologies will hit the retail sector like never before.

It is very important to understand the changes going on in the retail industry to determine the impact of these innovations. In fact, many of the leading online and mobile shopping retailers are now mapping new tech trends to explore and understand their impact in the retail and m-commerce industry. Almost all the studies revealed that image recognition is one of the standalone technologies that have the potential to have the highest impact on retail sales.

Image recognition technology allows mobile apps, software and systems to identify customers based on their facial features. Additionally, it can recognize products or objects based on their attributes. One of the biggest advantages of this technology is that it makes easier for customers to experience and interact with products.
This technology is geared towards providing a more personal experience to the buyers. It allows the systems and software to react to an individual on a personal level. Buyers can simply sit down in front of a computer device to enjoy a fully personalized online or mobile shopping experience. The technology empowers devices and websites to become intuitive, allowing them to react in a unique and engaging way. Better still, image recognition technology has the potential to improve customer safety by making online transactions more secure. As a result, this technology is becoming invaluable when it comes to the security perspective of online and mobile shopping.

From product perspective, image recognition technology will help customers with visual product searches by simply pointing their device at the product image. Consumers can find and scan their chosen products easily and effortlessly. This will further blur the lines between online/ mobile shopping and high street shopping. Thus, it is making the whole world a shop window for buyers. Static product images on catalogs, billboards, newspapers and magazines can come to life and provide a direct link to the retailer location or online site. And all these can be achieved by using the camera of your smartphone or tablet.

Considering the various advantages of image recognition technology, many of the brands and online/ m-commerce retailers are using this emerging technology to make shopping more interactive. In fact, brands and retailers are creating more number of augmented reality apps using this technology. Consumers need to simply take a picture of the product and the app will match the photo referring to their database and provide all required information to help consumers make their purchase decision.

Emerging technologies like image recognition can create enormous opportunities for retailers; however, their real advantages are yet to be fully realized.
